The Websites and the Services are owned and operated by Chegg. Unless otherwise specified, all materials appearing on the Websites, including the text, site design, logos, graphics, bibliographic information, icons, and book cover images, as well as the selection, assembly and arrangement thereof, are the sole property of Chegg and its licensors. All rights in images of books or other publications included in the Services are reserved by the original copyright owners. Portions of the bibliographic content included in the Services are supplied by third parties. You may only use the content of the Websites for your own personal use. You agree not to view, copy, or procure content or information from the Websites by automated means (such as scripts, bots, spiders, crawlers, or scrapers) unless formally authorized by Chegg under separate written agreement. If you receive as part of your order any access codes or Passwords or downloads for online eBooks or publisher created online digital services content ("Digital Content"), then, when activating the codes, downloading content or logging in to access or use Digital Content, you will be required to agree to certain additional terms and conditions ("Digital Content Terms") before you may access the Digital Content; a copy of those terms may be viewed here and are hereby incorporated into this agreement. Read the Digital Content Terms for each Digital Content you rent or purchase, as different Digital Content may come with different restrictions or may be updated from time to time. If there is an express conflict between the Digital Content Terms and the rest of the Terms of Use, the Digital Content Terms supersede the Terms of Use only to the extent of your use of the relevant Digital Content. For purposes of these Terms of Use, Chegg's homework help services offered through Cramster.com and Chegg's course scheduling services offered through Courserank.com are not included in the definition of "Digital Content."
When you submit, post, upload, embed, display, communicate, link to, email or otherwise distribute or publish (collectively, "Submit") any review, problem, suggestion, idea, solution, question, answer, class notes, course outline, comment, testimonial, feedback, message, image, text or other material ("User Content") to Chegg, any Chegg employee or contractor, or a Chegg Web site, you grant Chegg and our affiliates, licensees, distributors, agents, representatives and other entities or individuals authorized by Chegg, a non-exclusive, worldwide, perpetual, unlimited, irrevocable, royalty-free, fully sublicensable (through multiple tiers) and fully transferable right to exercise any and all copyright, trademark, publicity, and database rights you have in the content, in any media known now or in the future, and to make, use, reproduce, copy, display, publish, exhibit, distribute, modify, sell, offer for sale, create derivative works based upon and otherwise use the User Content. Chegg is not required to host, display, or distribute, and may remove at any time, any User Content. Although Chegg will not modify or edit any Content, it does reserve the right to change the format, sizing, and any other display specifications of the Content as it sees fit. You represent and warrant that (i) you own the User Content Submitted by you on, through or in connection with the Services, or otherwise have the right to grant the license set forth in this section, and (ii) the posting of your User Content on, through or in connection with the Services and/or Linked Services does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. This "User Content" section shall survive any expiration or termination of your relationship with Chegg.
We may, but are not obligated to, review User Content prior to posting it on or distributing it through the Websites, or allowing them to be distributed through the Website. This includes private messages exchanged by you and other users through the Websites. We reserve the right to prohibit any User Content from being distributed and we may remove User Content from the Website at any time for any reason.

The list prices displayed on the Websites come from bibliographic information we receive from leading third-party sources and publishers. Each list price is the publisher's suggested retail price. Chegg is not responsible for errors in that third-party data, including prices for the sale or purchase (buyback) of books. If a title does not have a publisher's suggested list price, the Websites may not show a list price in the online catalog. If a product is listed at an incorrect price due to typographical error or an error in pricing information received from our suppliers or for any other reason, Chegg shall have the right to refuse or cancel any order, whether or not the order has been confirmed and your credit or debit card charged. If your credit or debit card has already been charged and your order is canceled, Chegg will issue a credit to your credit or debit card account.
Chegg reserves the right, in our sole discretion, to make changes to the Websites and the Services at any time. Any description of the Services provided by Chegg is not a representation that the Services are working or will always work in that manner, as Chegg is continuously updating the Websites and the Services, and these updates may not always be reflected in the Terms of Use.
You may access the Websites and use the Services through mobile devices in accordance with Chegg's instructions. By downloading the software required to facilitate your use of the Websites or the Services, you accept the terms of the End User License Agreement provided with the software at the time of download or installation, as well as any updates. Certain features of the Websites and/or the Services may not be available through a mobile device. In addition, by accessing the Services through a mobile device, you agree that information about your use of the Website and Services through your mobile device may be communicated to Chegg, including without limitation your mobile device ID, your mobile carrier, and your physical location. Use of the Services through a mobile device may cause data to be displayed on and through your mobile device which may be viewed by your mobile carrier or other access provider. You may also opt to receive text message reminders from Chegg, as a courtesy to you. Please review our text message mobile disclosures, which are incorporated into the Terms of Use and may be updated by Chegg from time to time without notice. You are still responsible for compliance with the Terms of Use, including, e.g., timely return of your books, whether or not you receive such reminders. If you use any ISBN scan feature of the Services, you are responsible for verifying the accuracy of the scanned code before relying on it. Please also be aware your mobile access provider's usual fees and charges will apply to your use of the Websites and Services, including any text messages you opt-in to receive from Chegg, and you are responsible for those fees and charges. If you change or terminate your mobile account, you are responsible for promptly updating your Chegg account information so that any messages or notices from Chegg regarding the Services are sent to you and not to the person who is assigned your old number.
Notifications or receipts from Chegg will be delivered to you by email at the address you provided to Chegg when you created your account or as later updated. You hereby agree and acknowledge that Chegg is not responsible to notify you in any way other than by email, even if you opt-in to receive text message reminders. Any such text notifications are a courtesy; you remain responsible for minding the due date(s) and other deadlines whether you receive communication from Chegg or not. Chegg will not ask you for your personal information, account username, and password, or any of your credit or debit card information via email or text message. Chegg will have no responsibility for any misuse of such information if you provide such information via email or text message.
You may cancel your account at any time throughout our Websites. Your account will only be cancelled and closed after you have returned all books that have been rented to you (if any) and all transactions have been processed including payment of assessed penalties or the cashing of any refund check. Chegg may cancel your account in its sole discretion any reason, including but not limited to inactivity or misuse.
Chegg may require users of some Websites or Services to provide a valid credit or debit card tied to an account at a financial institution when they register for an account (to ensure users are able to make applicable payments to Chegg) or upon ordering products or services. If a payment card is required, you are responsible for ensuring that a valid credit or debit card is associated with your Chegg account at all times (either the original card or a replacement). To confirm your card is valid, Chegg may initiate a "pending" charge for one dollar (US $1.00) on the account. This charge will not be confirmed and, therefore, you will not be charged and it will simply disappear from your financial statement (usually within seven days - check with your financial institution for additional information). Please be aware that this $1.00 pending charge may be initiated each time you edit the card information for your account or place an order that cannot be processed. Where your billing address is requested, you must provide the address and phone number your financial institution has on record, as well as the card's CVV (card security code). Chegg will make reasonable efforts to process your transactions in a timely manner, but we make no guarantees regarding the processing time for charges. Chegg will store your credit or debit card information, encrypted, and you hereby acknowledge and agree that Chegg may charge you for, and you will pay for, any charges specified on the Web sites and for any auto-extension or unreturned, lost, stolen, or damaged books associated with your account under the terms of your book rental. Chegg reserves the right to place you into collections if you fail to timely pay for the products and services ordered through the Service;; collections may be done by Chegg or a third party on Chegg's behalf. You also agree that we may, at our discretion, send your account to a collection agency, and recover our reasonable costs of collection from you, if you fail to pay all fees due and owing to Chegg.
From time to time, Chegg may issue you Chegg Credit. Upon providing you credit, Chegg may place limits on its use, and Chegg Credit may not be moved from one Chegg service to another. If provided to you in exchange for goods or services or as a refund, it will not expire. If the credit was given to you with terms explicitly authorizing redemption for cash, you may convert that credit to cash. If you receive a credit from customer support, you may not redeem it for cash.
From time to time, Chegg may offer discounts, bonuses, coupons or other promotional incentives. These incentives typically have their own specific rules, restrictions and limitations (e.g., limiting when, how often, and under what circumstances you may be eligible for the promotion). You are responsible for carefully reviewing and complying with these applicable rules, restrictions and limitations; certain promotions may not apply in certain jurisdictions where prohibited by law. They are generally designed to prohibit self-dealing, collusion, smurfing (defined as breaking large orders or sales transactions into multiple individual transactions for the purpose of obtaining multiple discounts or payments), or otherwise gaming or defrauding the system. By participating in such promotions, you agree to be bound by the applicable terms and conditions, and that Chegg, in its sole discretion, may deny payment or benefits (e.g., when it believes improper activity has occurred or when a code has expired). All promotions may expire at any time without notice to recipients. Promotions apply only toward the actual base product/service rental or purchase cost; they do not apply to taxes, shipping, extension or late fees, or any other additional fees (e.g., conversion to purchase fees).
We may tie your Chegg experience to information about the school you have identified to Chegg. For certain schools, the Websites enable you to search and retrieve information about the materials required for particular courses. Please be aware that course information and assigned materials may change from time to time, and Chegg may not receive updated information from the school in a timely manner. Chegg is not responsible for any errors in the information provided in the course searches on the Websites. Where specific school names or information relate to a specific school are displayed, they do not imply any endorsement or approval by the school. Except where specifically stated, Chegg has no affiliation with or endorsement from any academic institution, and school names and information are used on the Websites only to the extent necessary to organize, identify and permit use of information and sections of the Websites that may be tailored to students of a particular school, or for other lawful uses.
Through the Services, you may purchase, as a separate product, a digital access code (DAC) to certain Digital Content. The DAC publishers allow only one user (one activation) of these codes. Chegg will ship your ordered DAC to you in sealed packaging. If the DAC packaging is opened, Chegg must assume that the code is activated and therefore cannot be resold. Thus, you may not return a DAC with opened packaging for a refund.
Rentals and purchases through the Services may be subject to taxes in many states because Chegg has physical property (the books or other items) in every state. Depending on your state and the nature of the product or service you receive from us, this may be a rental tax, sales tax and/or use tax. Tax rates are different from state to state. You are responsible for paying all such taxes.
Unfortunately, we cannot guarantee that supplemental materials (CDs and CD-ROMs, Workbooks, Study Guides) will be included with book rentals. However, they are available for purchase on select titles. If you receive your rental book with any of the above items, you are welcome to use it. We ask that you return your book complete with any supplemental materials you received.
All rentals remain the property of Chegg even while the item is in your possession. You may be given the option to purchase rented books from Chegg, either at the end of a rental cycle or at any point during the rental cycle. If you wish to purchase a book you have rented through the Services, you may be able to do so by accessing your account on the Websites and looking for the purchase option. In this case, title (ownership) transfers to you as soon as your credit or debit card is authorized for purchase value. If you purchase the title through our purchase program, title (ownership) changes hands as soon as you receive the product. Certain digital products may not be available for purchase or may have different purchase terms, and you should review their specific terms prior to rental or purchase.
The following policies, including all policies referenced therein, are part of this Terms of Use and provide additional terms and conditions related to specific services offered on our Websites: http://www.chegg.com/generalpolicies/. These policies may change from time to time. Changes take effect when we post them on the site. When using particular services on our Websites, you are subject to any posted policies or rules applicable to services you use through the sites. All such policies or rules are hereby incorporated into these Terms of Use.
You may use Chegg's homework help services, which include Cramster.com, as a "Member" or a "Visitor." "Members" may include a variety of designated levels of members who may be charged for services according to the terms of the particular offer, or registered free members (a "Free Member"), or other membership levels. "Visitors" are users that have not registered for an account with access to and use of certain aspects of the homework help services (e.g., certain products and services, activities and/or content and materials of Cramster.com), which may be restricted and only available to certain Members. The membership levels, the benefits and pricing of each level of membership may vary and are subject to change at any time, please read the terms of any particular level of membership carefully before accepting it. Chegg may modify these levels and benefits from time to time, and each such modification is effective as soon as we post it on the relevant Websites except to the extent that your particular pricing structure is established in writing for a period of time in the future, such as an annual plan. It is therefore important that you review the membership page regularly to ensure you are aware of any such changes.
Chegg's homework help services are available merely as informational and study aids and should not be considered substitutes for applicable coursework, homework, class and lecture requirements, assignments and related materials. In using the Websites, you specifically agree not to use, claim or submit as your own any portion of the homework help materials. Chegg does not guarantee the accuracy or quality of answers or other study material that appear on its site. You further agree the Websites may present information that is incorrect or inconsistent when compared to similar content and materials, including solutions and their methodologies, provided or preferred by publishers of applicable problems or instructors of applicable courses.
Payment for homework help services is due in advance of each applicable membership period (e.g., monthly or annually). MONTHLY AND ANNUAL MEMBERSHIPS AUTOMATICALLY RENEW AND YOUR CREDIT CARD OR OTHER PAYMENT METHOD YOU PROVIDE WILL BE CHARGED ON THE FIRST DAY OF EACH RENEWAL PERIOD UNTIL YOUR MEMBERSHIP IS TERMINATED BY US OR CANCELLED BY YOU. You may elect to temporarily "suspend" your membership, for example, during school breaks or vacation, for up to a total of 90 days in any one membership year (i.e., during each 12-month period following the commencement of your membership), and the period of your membership will be extended by the total amount of such suspended period(s). You agree to pay all applicable fees for your membership and use of the homework help services, plus any applicable taxes or other charges as may be required, when due and payable. All fees and charges are payable in advance and non-refundable, including after cancellation. If you wish to cancel your homework help membership, please visit the customer support web area on the Website. Cancellation of memberships will take effect at the end of the applicable then-current billing period for which payment has been made in advance as described above.
We may from time to time offer free trials for some of our Services. Such trials may require you to register with a valid credit card to commence. Users that sign up for a free trial membership at a particular level will be automatically renewed at the promoted membership rate for that level at the end of the trial period unless the user cancels the membership at least before the end of the trial, unless the terms of the offer explicitly state otherwise. You can cancel a free trial online or by contacting Chegg's customer support. After cancellation of a free trial, you can continue as a Free Member with reduced benefits or access. Only one free trial membership is allowed per person. Subsequent registrations do not qualify for free trials. Unless the terms of a promotion state otherwise, for promotions that include "free" periods with "paid" periods, paid periods will elapse first. We may introduce new or additional features, services or materials to the Website which may be a part of, or priced separately from, existing levels of membership at our sole discretion.
All Vouchers printed from Chegg Deals ("Vouchers") are promotional vouchers that may be purchased from participating Merchants ("Merchants") through the Chegg Deals site to be used in exchange for products and services. The Merchant, not Chegg Deals, is the seller of the voucher and the products and services and is responsible for redeeming any Voucher you purchase. When a Chegg Deal is purchased, the purchaser's credit card will be charged within 24 hours. Sales tax will be collected, where applicable, upon redemption by Merchant. If gratuities are included in the purchase price, this will be made clear in the Offer. If not mentioned, gratuities are not included. Please make note of any relevant redemption details. By confirming your purchase at the end of the checkout process, you agree to accept and pay for the Offer(s) selected.
Once your payment is processed, you will be sent a Voucher. Print it out and make note of the instructions. Please contact Chegg Deals according to the website instructions if you have any questions. Each offer's redemption details differ and should be read carefully before making a purchase. Limit one Voucher per redemption. Only one Voucher can be used per order unless otherwise specified by the Merchant. Neither Chegg Deals nor the Merchant is responsible for lost or stolen Vouchers.
According to applicable law, the Merchant may be responsible for allowing you to redeem your Voucher for the cash value based on the money you actually paid for your Voucher for a period of time that extends beyond the expiration date on the Voucher. If a problem arises please contact Chegg Deals. Chegg Deals is not the Merchant and is not legally responsible for the products or services Chegg Deals offers. The holder and issuer of a Voucher is the Merchant, and Merchant is and shall be fully responsible for any and all injuries, damages, claims, illnesses, liabilities and costs suffered by or in respect of a customer, caused in whole or in part by the Merchant, as well as for any unclaimed property liability arising from unredeemed Vouchers or portions thereof. You waive, and release Chegg Deals and Chegg, Inc. and its officers, directors, employees and agents from, any claim, liabilities, damages, or injury arising from or related to any act or omission of Merchant in connection with a Voucher or the products and services provided in connection therewith and/or as it relates to compliance with applicable unclaimed property and other laws relating to the redemption of the Vouchers or any portion thereof. Vouchers are redeemable in their entirety and on a one time basis only and may not be redeemed incrementally unless stated otherwise.
If you have not yet redeemed your Voucher and you would like a refund, please contact Chegg Deals. If you have already redeemed your Voucher, and your question relates to the specific product or experience, please contact the Merchant.
Chegg (through, e.g., its Notehall and Cramster sites) permits users to upload and in some cases sell Content for the purpose of aiding others in the education and learning process. Users may not post Content created or owned by another person, represent and warrant that: (i) each created and is the sole owner of all Content posted to Chegg sites and all rights in such Content, including, without limitation, copyright and (ii) the posting of Content on or through Chegg sites will not breach the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights or any other rights of any third-party. Users agree to pay for all royalties, fees, and any other monies owing to any third-party for any Content provided by you to Chegg sites. Users of Chegg sites agree to exclude from such Content any documents, records or files made accessible to them by (a) your school, professor or other instructor, (b) any board of examination, (c) any author or publisher whose works have been used as part of studies or (d) any co-student.
In creating study related Content, students must respect any intellectual property rights that others may have in content. All Content posted on Chegg sites must be independently created, transformative and non-derivative. It should not be a transcript or recording of another's independent efforts, nor should it copy from materials purchased from or created by others. It should go beyond simply summarizing material covered in class or in written or recorded materials, but include information raised by students in or outside of class, and independent thought, analysis and commentary. Class notes, for example, must be substantially rewritten after class and include independent thought and analysis, research and information; notes that use a lecturer's words or that are not carefully reviewed, rethought and rewritten after class are not useful to or appreciated by students, and not permitted on Chegg sites.
Schools may have their own policies that place restrictions on a student's ability to make commercial use of study materials, even otherwise lawful materials that the student has independently created. You are responsible for becoming familiar with such policies and abiding by them, and discontinuing the use of any Chegg service if such use is contrary to your school policy or the instruction of your professor.
Class notes and study guides are solely for the specific use of students in the designated class for which they are created. Individuals who are not registered for a class may not purchase study guides, class notes or outlines for that class. Check the accuracy of all information from study guides, class notes and outlines - Chegg does not guarantee their accuracy or completeness, they are simply an aid to the study process.

ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU AND YOU MAY HAVE ADDITIONAL RIGHTS. IN THAT CASE, CHEGG'S LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. THE EXCLUSIONS AND LIMITATIONS OF LIABILITY IN THESE TERMS OF USE WILL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. THIS SECTION SHALL SURVIVE ANY EXPIRATION OR TERMINATION OF YOUR RELATIONSHIP WITH CHEGG.
You agree to defend, indemnify and hold harmless Chegg, its subsidiaries and affiliates (including their respective owners, directors, officers, employees, agents, representatives and agents) from and against any and all loss, liability, claims and demands (including, without limitation, reasonable attorneys' fees, costs and expenses) arising out of or relating to (a) any violation by you of the Terms of Use, or (b) any breach of any of your representations or warranties in the Terms of Use. These indemnity obligations shall survive any expiration or termination of your relationship with Chegg.
Chegg respects the intellectual property rights of others and takes the protection of copyrights and other intellectual property seriously. If you believe your work has been infringed through the Websites or the Services, please notify us at copyrightagent@Chegg.com or at Chegg, Inc., Attention: Copyright Agent, 2350 Mission College Blvd, Suite 1400, Santa Clara CA 95054, and provide the following information:
IF YOU KNOWINGLY MISREPRESENT THAT MATERIAL IS OR IS NOT INFRINGING, YOU MAY BE SUBJECT TO CIVIL PENALTIES. THESE INCLUDE MONETARY DAMAGES, COURT COSTS, AND ATTORNEYS' FEES INCURRED BY CHEGG, BY ANY COPYRIGHT OWNER, OR BY ANY COPYRIGHT OWNER'S LICENSEE THAT IS INJURED AS A RESULT OF RELIANCE UPON YOUR MISREPRESENTATION. YOU MAY ALSO BE SUBJECT TO CRIMINAL PROSECUTION FOR PERJURY. You agree we may provide your notice to the provider of the allegedly infringing material. We have a policy of terminating accounts of users who repeatedly and intentionally infringe the intellectual property rights of others.
If a dispute arises between you and Chegg, our goal is to provide you with a neutral and cost effective means of resolving the dispute quickly. Accordingly, you agree that we will resolve any claim or controversy at law or equity that relates to or arises out of the Terms of Use or the Services or your use of the Services (a "Claim") in accordance with the subsections below.
>General. You and Chegg agree that any dispute, claim or controversy arising out of or relating to these Terms of Use or the breach, termination, enforcement, interpretation or validity thereof (collectively, "Disputes") will be settled by binding arbitration; except that either party retains the right to bring an individual action in small claims court. You acknowledge and agree that you and Chegg are each waiving the right to a trial by jury or to participate as a plaintiff or class member in any purported class action or representative proceeding. Further, unless both you and Chegg otherwise agree, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of any class or representative proceeding. If this specific paragraph is held unenforceable, then the entirety of this "Legal Disputes" section will be deemed void. This "Legal Disputes" section will survive any termination of these Terms of Use. Notwithstanding the foregoing, each party reserves the right to seek injunctive or other equitable relief in a court of competent jurisdiction with respect to any dispute related to the actual or threatened infringement, misappropriation or violation of a party's intellectual property or proprietary rights or breach of the User Content and Activities provisions of this Agreement.
Arbitration Rules, Governing Law, Jurisdiction and Venue. The arbitration will be administered by the American Arbitration Association ("AAA") in accordance with the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (the "AAA Rules") then in effect, except as modified by this Section of these Terms of Use. (The AAA Rules are available at www.adr.org/arb_med or by calling the AAA at 1-800-778-7879.) The Federal Arbitration Act will govern the interpretation and enforcement of this Section. These Terms and any action related thereto will be governed by the laws of the State of California without regard to its conflict of laws provisions. The exclusive jurisdiction and venue of any action taken in a small claims court as contemplated by these terms will be the courts located in the Northern District of California and each of the parties hereto waives any objection to jurisdiction and venue in such courts.
Arbitration Process. A party who desires to initiate arbitration must provide the other party with a written Demand for Arbitration as specified in the AAA Rules. (The AAA provides a form Demand for Arbitration at www.adr.org/si.asp?id=3477 and a separate form for California residents at www.adr.org/si.asp?id=3485.) The arbitrator will be either a retired judge or an attorney licensed to practice law in the state of California and will be selected by the parties from the AAA's roster of consumer dispute arbitrators. If the parties are unable to agree upon an arbitrator within seven (7) days of delivery of the Demand for Arbitration, then the AAA will appoint the arbitrator in accordance with the AAA Rules.
Arbitration Location and Procedure. Unless you and Chegg otherwise agree, the arbitration will be conducted in the county where you reside. If your claim does not exceed $10,000, then the arbitration will be conducted solely on the basis of documents you and Chegg submit to the arbitrator, unless you request a hearing or the arbitrator determines that a hearing is necessary. If your claim exceeds $10,000, your right to a hearing will be determined by the AAA Rules. Subject to the AAA Rules, the arbitrator will have the discretion to direct a reasonable exchange of information by the parties, consistent with the expedited nature of the arbitration.
Arbitrator's Decision. The arbitrator will render an award within the time frame specified in the AAA Rules. The arbitrator's decision will include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court having jurisdiction thereof. The arbitrator's award damages must be consistent with the terms of Limitation of Liability section of these Terms of Use as to the types and the amounts of damages for which a party may be held liable. The arbitrator may award declaratory or injunctive relief only in favor of the claimant and only to the extent necessary to provide relief warranted by the claimant's individual claim. If you prevail in arbitration you will be entitled to an award of attorneys' fees and expenses, to the extent provided under applicable law. Chegg will not seek, and hereby waives all rights it may have under applicable law to recover, attorneys' fees and expenses if it prevails in arbitration.
Fees. Your responsibility to pay any AAA filing, administrative and arbitrator fees will be solely as set forth in the AAA Rules. However, if your claim for damages does not exceed $75,000, Chegg will pay all such fees unless the arbitrator finds that either the substance of your claim or the relief sought in your Demand for Arbitration was frivolous or was brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)).
Changes. If Chegg changes this Legal Disputes section, you may reject any such change by sending us written notice (including by email to legaldept@chegg.com) within 30 days of the date such change became effective, as indicated in the "Last Updated" date. By rejecting any change, you are agreeing that you will arbitrate any Dispute between you and Chegg in accordance with the provisions of this Section as of the date you first accepted the terms of these Terms of Use (or accepted any subsequent changes to these Terms of Use).
This "Legal Disputes" section shall survive any expiration or termination of your relationship with Chegg.
We work diligently to prevent misuse, but ultimately, the choice to act with academic honor and integrity is your own. We know that most of you have never and will never abuse the Websites or any of the information, services or materials available through them. We take this opportunity, then, to highlight our commitment and your own. We require every user and member to abide by our Honor Code.
You may not use any of the solutions, answers, materials or information available on or through our Websites and Services, to cheat. Examples include:
1. Submitting any textbook solutions from the Website as your own to any class.
2. Using our questions and answers service to complete tests or homework when instructed not to use outside help.
3. Otherwise passing along any solutions, answers, materials or information from the Website as your own.
4. Any other violation of your instructor's or school's academic honor code.
We will take swift action against anyone found violating this Honor Code. If Chegg is presented with evidence that its Services have been used in a manner contrary to its code, Chegg may, in its sole discretion, remove the materials and terminate the account of the involved users.
As current and former students, the Chegg team understands the pressures and time constraints school creates. That being said, we also know from the unfortunate tales of our peers that the risk you take by violating your school's code of academic integrity is not worth the reward. Copying solutions or posting unexplained final answers promotes completion without comprehension, and that's something we don't support on this site.
We are always seeking opportunities to work with educators in making our Websites a valuable resource for both you and your classroom for years to come. If you need to contact us concerning an issue of academic integrity, please e-mail us at honorcode@chegg.com.
If any provision of the Terms of Use is declared invalid, illegal or unenforceable, all remaining provisions continue in full force and effect. The failure of Chegg to exercise or enforce any right or provision of the Terms of Use is not a waiver of such right or provision. The section titles of the Terms of Use are for convenience only and have no legal or contractual effect. Non-performance of either party, except for the failure to make required payments, will be excused to the extent performance is delayed or rendered impossible by any reason where failure to perform is beyond the reasonable control of the non-performing party. This "Miscellaneous" section shall survive any expiration or termination of your relationship with Chegg.
Chegg may modify the Terms of Use including the linked policies contained herein from time to time, and each such modification is effective as soon as we post it on the relevant Websites. By using our Services, you agree to be bound by the then-current version of the Terms of Use, including any changes we may have made since the last time you used our Services. It is therefore important that you review the Terms of Use regularly to ensure you are aware of any such changes.
The then-current Chegg Terms of Use, including (a) any related policies and terms referenced in the Terms of Use and (b) any additional terms and conditions provided to you by Chegg when you use certain features of the Websites or Services, are the entire agreement between you and Chegg regarding the Websites and the Services. The Terms of Use may not be modified without the consent of a duly authorized representative of Chegg, and will supersede and prevail over any terms or conditions you may include with any purchase order or other transaction document or communication with us, regardless of whether Chegg signs them or fails to object to them. This "Entire Agreement" section shall survive any expiration or termination of your relationship with Chegg.
If you have any questions or concerns regarding the Chegg Websites or Services, please write to us at http://www.chegg.com/contactus/ or at our offices located at 2350 Mission College Blvd., Suite 1400, Santa Clara, CA 95054. All notices, authorizations, and requests to Chegg shall be deemed given on receipt.

In addition, you may have the ability to contact another user through the Services or “follow” or “friend” other users. When you contact another user, we may list your name in the header of the message or in the wall post or notification, but we will not include your personal email address. We allow other users to use contact information they have about you, such as your email address, to find you, including through contact importers and search, and they may also contact you through the Services. Also, the Services may permit interactions between the Services and a third party web site, such as enabling you to “like” a product within our Services or “share” content to other web sites. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Site. Third parties may provide us with information about you. You may also choose to participate in a third party application or feature through our Services (such as logging in through Facebook Connect or otherwise linking the Services with another web site or interactive service) or on a third party web site or service (such as one of our Facebook applications or a similar application or feature on a third party web site or service) through which you allow us to collect (or the third party to share) information about you, including personal information. When you choose to participate, you may be opting to link your activity on our Services with that third party web site or service, which may then collect information about your visits to our Services and may publish that activity as you request to your profile or similar feature with that third party (such as if you choose to share a purchase you made on Chegg.com with your connections on the third party web site).√Ǭ† The information we collect is subject to this Privacy Policy.√Ǭ† The information collected and stored by the third party remains subject to the third party’s privacy practices, including whether the third party continues to share information with us, the types of information shared, and your choices with regard to what is visible to others on that third party web site and service. The third party may allow you to remove the application or feature, in which case we will no longer collect information about you through the application or feature, but we may retain the information previously collected. In addition, we may receive information about you if other users of a third party web site or service give us access to their profiles and you are one of their “connections” or information about you is otherwise accessible through your “connections” web page, profile page, or similar page on a social networking or other third party web site or interactive service. We also may supplement the information we collect with outside records from third parties in order to provide you with information, services or goods you have requested. We may combine the information we receive from those other sources with information we collect through the Services. In those cases, we will apply this Privacy Policy to the combined information.
The Services may offer referral features whereby users may use an email tool to invite friends to use the Services using a one-time email. Chegg stores this information for the purpose of verification, as well as tracking the success of our referral program. Chegg will not use those referred email addresses for any other purpose (unless, of course, the referred user comes to a Service and registers as a user, in which case Chegg may use the email address provided by the referred user in accordance with this Privacy Policy). The referred person may contact us at legaldept@chegg.com to request that we remove this information from our database.
If you purchase a gift certificate for another person, we will ask you for that person's name and email address, as well as for an optional personal message. We will automatically send your friend a one-time email including an invitation to visit the site as well as their gift code. Chegg stores information such as the gift certificate recipient's name and email address for the sole purpose of verification. Chegg does not sell or disclose any of this information to any outside sources or parties and collects this information only to maintain records that a gift certificate was purchased and sent to a recipient. Vouchers purchased through Cheggdeals are not gift certificates and must be used according to the terms of the voucher.
Like other websites and online services, we and our analytics providers and other third party service providers may collect certain “Usage Information” whenever you access and use the Services. Usage Information may include the browser and operating system you are using, the URL or advertisement that referred you to our Services, the search terms you entered into a search engine that lead you to our Services (if applicable), all of the areas within our Services that you visit, and the time of day, among other information. We may use Usage Information for a variety of purposes, including enhancing or otherwise improving the Services and our products and services.
In addition, we automatically collect your IP address or other unique identifier (“Device Identifier”) for any computer, mobile phone or other device (any, a “Device”) you may use to access the Services. A Device Identifier is a number that is automatically assigned to your Device used to access a Service, and our servers identify your Device by its Device Identifier. Some mobile service providers may also provide us or our third party service providers with information regarding the physical location of the Device used to access a Service. Usage Information is generally non-identifying, but if we associate it with you as a specific and identifiable person, we treat it as Personal Information.
Usage Information is collected via tracking technologies, including:
Cookies and Log Files: Like most websites, Chegg uses cookies and web log files to track usage of our Services. A cookie is a tiny data file which resides on your computer, and which allows Chegg to recognize you as a user when you return using the same computer and web browser. If your browser settings do not allow cookies, you will not be able to use our Services as fully as intended. Log files are the record of your visits to the Services and include Usage Information. Like the information you enter at registration or in your Public Profile, cookie and log file data is used to customize your experience when you use the Services.
One type of cookie we use, known as a “persistent” cookie, is set once you’ve logged in to your account on the Services. If you do not log out of your account, then the next time you visit, the persistent cookie will allow us to recognize you as an existing user so you will not need to log in before using the Services. Of course, if you are using a public computer or sharing your private computer with others, you should log out of your account after each visit. If you log out of a Service, you will need to re-enter your password the next time you visit in order to log in to your account. We also use a cookie which functions as a “session” cookie, meaning that it is used to identify a particular visit. Session cookies expire after a short time or when you close your web browser.
Web Beacons: We, as well as our affiliate program partners, third-party tracking utility companies, and service providers employ a software technology called clear gifs (a.k.a. web beacons/web bugs), that help us better manage content on our site by informing us of what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web users for our affiliate program. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on web pages and are about the size of the period at the end of this sentence. This information is used to help improve the overall quality and experience of our website.
An Embedded Script is programming code that is designed to collect information about your interactions with the Services, such as the links you click on. The code is temporarily downloaded onto your computer or other device from our server or a third party service provider and is deactivated or deleted when you disconnect from the Services.
In addition, we may use a variety of other technologies that collect similar information for security and fraud detection purposes.
Chegg works with network advertisers, ad agencies , third party traffic measurement services and other vendors to serve third party advertisements on and through the Services, to provide us with information regarding traffic on the Services, including the pages viewed and the actions users take when visiting the Services; to serve our advertisements on other web sites, within third party applications, and across the Internet; and to provide us with information regarding the use of the Services and the effectiveness of our advertisements. For example, if you clicked on an advertisement that led you to one of our Services, our service provider(s) may be able to tell us which advertisement you clicked on and where you were viewing the advertisement. In connection with providing analytics and advertisement services, our service providers may collect certain information about your visits to this or other web sites. We do not share Personal Information with these service providers, but they may set and access their own tracking technologies on your Device (including cookies and web beacons) and may otherwise collect or have access to information about you (such as your general interest in higher education and scholarships and Usage Information).
With regard to advertisements, we and our network advertisers may target advertisements for products and services in which you might be interested based on your visits to both the Services and other web sites. Tracking technologies, such as cookies and web beacons, including those set by third party network advertisers, may be used to, among other things, target advertisements, prevent you from seeing the same advertisements too many times, or to conduct research regarding the usefulness of certain advertisements to you. We may share Usage Information about visitors with third party advertising companies, analytics providers and other vendors for similar purposes. We may use a variety of companies to serve advertisements. You may wish to visit http://www.networkadvertising.org/managing/opt_out.asp, which provides information regarding the "opt-out" procedures of certain third party ad servers we may use.
Chegg also works with Truste which gives you the ability to opt out of some or all tailored advertising networks. To learn more about the use of this information or choose not to have this information used by our third-party advertising partners by opting out, please visit the Truste website here.
If you use the Services through a mobile device or our mobile application, your mobile device ID, your mobile carrier, and your physical (GPS) location may be transmitted to Chegg. You agree that Chegg may store and use that information for security purposes (for example, for user verification and to ensure that Chegg's APIs are being used appropriately) and, if available, for purposes of assisting you in locating nearby shipping stores, schools or other places of interest. Chegg does not share your location information with third parties except for a location service provider Google Maps. If you wish to no longer allow Chegg to track your physical locations you may turn this off within your device settings. When you place an order through the Services, you may be able to opt-in to receiving text messaging reminders from Chegg. If you choose to do so, you must provide to Chegg your telephone number, which Chegg will store and use to send reminders to you. You may always opt-out by replying “STOP” to one of the text messages received. You also acknowledge and agree that use of the Services through a mobile device may cause data to be displayed on and through your mobile device which may be viewed by your mobile carrier or other access provider.
Chegg does not share your Personal Information with third parties for their marketing purposes without your consent. Chegg may share non-Personal Information, such as aggregate user statistics, demographic information and Usage Information with third parties, and third parties, including third party advertisers, content providers, and analytics providers, may collect such information when you visit the Services. We also may share your Personal Information with third parties with your consent, as disclosed at the time you provide us with information, and as described below or otherwise in this privacy policy:
If you choose to use the Powered by Chegg® kiosk at a participating Authorized Chegg Affiliate, the affiliate will be provided with your personal information, including your contact information, the books you are renting, and rental fees. These affiliates are permitted to use your Personal Information only for purposes of processing the transaction and providing the service.
You may be able to review the information you provided to us on a Service and make any desired changes to the information, or to the settings for your account on that Service, by logging in to your account for that Service and editing the information. You also may be able to limit the information you receive from us by adjusting your settings. For Zinch.com, we reserve the right to send you information on our behalf and on behalf of third parties in connection with our providing the Services and therefore, with regard to Zinch.com, if you no longer want to receive information from us, you will need to close your account for that Service.
Please note that the default setting in any Public Profile on a Service may be that the information in your Public Profile is available to everyone on the internet. This is the case on Zinch.com, where the default setting is for your Public Profile to be public. You may be able to customize your Public Profile and opt out of making certain information visible to the public. For Zinch.com, note that if you choose to remove certain information from your Public Profile, such information will still be available for viewing and use by Educational Institutions and Chegg.
If you wish to close your account with Zinch.com, please send your request to help@zinch.com and we will remove your Personal Information and Public Profile, if applicable, from the active databases. If you wish to close your account on any of our other Services, please send your request to opt-out@chegg.com. Please send your request using an email account that you have registered with Chegg under your name. You will receive a response to a request sent to opt-out@chegg.com within five business days of our receiving it. Closing your account on one of our Services does not necessarily mean you have closed your account on another one of our Services, and therefore, you may continue to receive communications from Chegg in relation to your membership on another Service.
Even if your account is closed, information may remain in backup records and we may retain certain data if it may be necessary to prevent fraud or future abuse or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery or if required by law. All retained data will continue to be subject to the terms of the applicable privacy policy for the Service. Also, if you have posted content on or through the Services, such as in Community Forums, we may not be able to delete it.
Certain content provided through the Services may be hosted and served by third parties, which may include third party widgets (such as those that allow you to “like” or “share” content with third party web sites and online services. In addition, the Services may link to third party web sites or content over which Chegg has no control and which are governed by the privacy policies and business practices of those third parties. In addition, third-party partners of Chegg from whom your order through the Services may have different privacy policies which apply to such partner’s use of your information.
Please also note that Chegg content and widgets may be included on web pages and web sites that are not associated with us and over which we have no control. These third parties may independently collect data. Chegg is not responsible for the privacy practices or business practices of any third party.
Chegg takes commercially reasonable security measures to protect the personal information submitted to us, both during transmission and once we receive it. For example, when you enter sensitive information such as a geolocation data, credit card number and CCV2 number on our checkout forms, that information is encrypted using secure socket layer (SSL) technology, to help protect the communications between you and our payment partners.
However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, as in any real-life scenario, we cannot guarantee its absolute security.

Pursuant to California Civil Code Section 1798.83, residents of the State of California have the right to request from companies conducting business in California a list of all third parties to which the company has disclosed certain categories of personal information during the preceding year for the third parties’ direct marketing purposes and the categories of personal information the company shares. Alternatively, the law provides that a company that has a privacy policy that provides consumers choice (opt-out or opt-in) regarding sharing personal information with third parties for those third parties’ direct marketing purposes may instead provide information on how to exercise that choice. Chegg qualifies for the alternative option; it has a comprehensive privacy policy that sets forth that Chegg provides you choice prior to sharing your personal information with third parties for their direct marketing purposes.
